Beijing Business Daily News (reporter Qian Yu Pu Zhenyu) on July 31, the Ministry of Industry and Information Technology issued a message that in the second quarter of 2019, telecommunications management agencies in accordance with the “Telecommunications Regulations” and “Telecommunications Business Licensing Management Measures” and other relevant provisions, 11453 enterprises were included in the list of poor telecom business operations, and are now published.
Among the unhealthy lists published in this batch, all the three major domestic operators were listed, including Pingxiang Branch of China Mobile, Jinxian Branch of China Telecom, Jiaxing Branch of China Unicom and Ali Cloud Computing Co., Ltd. for failing to cooperate with supervision and inspection, providing Internet access services in violation of regulations, and receiving without consent. Acts such as collecting user information are subject to administrative penalties imposed by telecommunications management agencies, 11 435 enterprises fail to fulfill their annual reporting obligations as required, and 3 enterprises are required to do so because of the two situations mentioned above at the same time.
In fact, it is not uncommon for the three major operators to enter the bad list. China Unicom Changchun Branch, Fujian Branch of China Unicom and Chifeng Branch of China Telecom were listed in the list of the first batch of bad telecom operations published by the Ministry of Industry and Communications in 2019.
However, compared with the three major operators, private enterprises have become the “main force” on the bad list. According to the data released by China Information and Communication Research Institute, by the end of June 2019, 464 state-owned holding enterprises accounted for 3.0% of the total number of operators, 1 529 private holding enterprises accounted for 96.3% of the total number of operators, and 103 foreign-invested enterprises accounted for 0.7% of the total number of operators.
It is understood that the list of poor telecom business operation is the innovation of supervision methods carried out by the regulatory authorities in order to improve the telecom market environment. Once entering the bad list, it means that there are irregular or even illegal business practices in the relevant enterprises, that is, there are problems in business management.
According to the Circular of the Ministry of Industry and Information Technology on Doing a Good Job in the Management of Telecommunication Business Bad List and Breaking Credit, the operators of telecommunications business should be included in the list of telecommunications business bad operation in one of the following three situations: (1) failing to report the annual report information according to the regulations, and failing to perform the annual report within the time limit of the telecommunications management agencies. Obligations; (2) Failure to go through the formalities of change in time according to the regulations when the information specified in the telecommunication business operation license changes, and incur administrative penalties; (3) In the supervision and inspection of telecommunication management institutions, the annual report information, daily business activities, the implementation of network and information security management responsibilities, and the suspension of business operations are found. Those who violate laws and regulations in the rehabilitation work, the implementation of relevant provisions of the state and telecommunications regulatory agencies, and are subject to administrative penalties (except those that need to be listed directly in the list of telecommunications business operation dishonesty).
It is noteworthy that the development of related enterprises will be adversely affected after the Ministry of Industry and Information Technology has been listed as a list of poor Telecom operations. According to the notification of the Ministry of Industry and Information Technology in March 2018, the operators of basic telecommunication services and related network access services should take the bad list as an important consideration when providing communication resources, network access or other business cooperation. In the bidding activities of relevant enterprises in the information and communication industry, the bad list can be taken as a consideration factor.
